MyVitalog Terms of Use

1. Acceptance of Terms

By downloading, installing, or using MyVitalog ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. These terms apply to all users of the App, including individuals managing health records for family members.

2. Medical Disclaimer — Please Read Carefully

Specifically, you acknowledge and agree that:

• The App does not analyze, interpret, or comment on the medical meaning of any test result, value, or attachment you store.
• Reference figures shown in the App (such as typical radiation dose ranges for X-ray, CT, or PET-CT scans) are general educational approximations only, and are not personalized to you or any family member.
• Any "next checkup" reminder you set is based entirely on a date you enter yourself — the App does not recommend screening intervals or schedules.
• Optical character recognition (OCR) used to read text from photos may make errors. You are responsible for reviewing and correcting any text before relying on it.
• You must always consult a qualified physician, radiologist, or other healthcare professional for diagnosis, treatment decisions, or interpretation of any medical record, regardless of what is stored in the App.

Use of MyVitalog does not create a doctor-patient relationship between you and Irradiated Solution Application Pty Ltd, and the App must never be used as a substitute for professional medical care, including in emergencies. If you are experiencing a medical emergency, contact your local emergency services immediately.

3. License to Use the App

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use MyVitalog on Apple devices that you own or control, solely for your own personal and family record-keeping purposes. You may not:

• Copy, modify, reverse-engineer, or create derivative works of the App;
• Resell, sublicense, rent, or distribute the App or access to it;
• Use the App for any commercial health-record service offered to third parties;
• Remove or obscure any copyright, trademark, or proprietary notices.

4. Your Content & Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of all information, photos, and documents you enter into the App ("Your Content"). Because MyVitalog stores all data locally on your device:

• We have no ability to view, back up, recover, or moderate Your Content.
• You are responsible for safeguarding your device and any iCloud account used for backup.
• You are responsible for maintaining your own backups (for example, by enabling iCloud or exporting PDF reports) — we are not liable for data loss resulting from device damage, loss, theft, factory reset, or app deletion.
• If you store health information about another family member (such as a child or parent), you confirm you have the authority and consent to do so on their behalf.

5. Purchases

MyVitalog is offered as a paid application through the Apple App Store. All purchases are processed by Apple and governed by Apple's own terms and refund policies. We do not process payments directly and cannot issue refunds ourselves — refund requests must be made through Apple at reportaproblem.apple.com.

6. App Availability & Updates

We may update, modify, or discontinue features of the App at any time, and we do not guarantee that the App will be available, error-free, or uninterrupted at all times. We recommend keeping the App updated to the latest version available on the App Store for the best experience and security.

7. Limitation of Liability

• Your reliance on any information, reminder, or reference figure displayed in the App;
• Loss or corruption of data stored locally on your device or in your personal iCloud account;
• Errors in optical character recognition (OCR) or any other automated feature;
• Any medical decision made or not made based on information stored in or shared from the App.

Nothing in these Terms limits any liability that cannot be limited under applicable consumer protection law, including the Australian Consumer Law.

8. Termination

You may stop using MyVitalog at any time by deleting the App from your device. We may suspend or discontinue the App (for example, by removing it from the App Store) at our discretion, though we will make reasonable efforts to support existing users through standard App Store update mechanisms.

9. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the App will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
